Terms of Service

1. Who we are

Octo Services ("Octo", "we", "us") is operated by {{COMPANY_LEGAL_NAME}}, {{COMPANY_LEGAL_FORM}}, tax ID (NIF) {{COMPANY_NIF}}, registered office at {{REGISTERED_ADDRESS}}, entered in {{MERCANTILE_REGISTRY}}. These Terms govern access to and use of the platform by clients and by professional service providers.

2. What Octo is — and is not

Octo is an intermediary marketplace that connects clients who need a service with vetted professional providers across Spanish destinations (Ibiza first).

  • Octo is never a party to the service contract concluded between a client and a provider.
  • Octo never processes the client↔provider service payment. That payment, its invoicing and any refund are strictly between the client and the provider.
  • The performance, quality, warranties, timing and any dispute arising from the service are the sole responsibility of the client and the provider.

Octo only provides the technology that enables introductions, quoting and communication.

3. Accounts

Each account has exactly one role — no stacking. Signing up always creates a client account. Becoming a provider is a controlled promotion offered via our /pro page. Administrator access is assigned internally only.

You must provide accurate information, keep your credentials confidential, and use one account per person or business. You are responsible for activity under your account.

4. Provider obligations & validation

A provider account is activated only after all of: a complete profile, verified documents (identity and, where applicable, insurance/registration), a saved payment card, and manual admin approval.

Providers undertake to give honest, accurate and lawful information; to hold the licences, permits and insurance required for their activity; to keep coverage zones and availability current; to respond to clients in good faith; and to comply with applicable law and tax obligations.

5. Fees payable to Octo (providers only)

Clients pay Octo nothing. Providers pay Octo:

  • Lead unlock — a fee (default €5, configurable per subcategory) to reveal a client's contact details.
  • Service fee — 2% (or a fixed amount, per subcategory) charged when a client accepts the provider's quote, applied after a 48-hour safety window.
  • Premium — a €59/month subscription (visibility boost, priority lead window, directory page, badge).

Applicable fees are charged to the provider's saved card. Taxes are shown at the point of charge.

6. Reviews

Only the client of an accepted-quote engagement may leave a review, and only after the service is marked done. There is one review per engagement. Every review is moderated before publication; a provider may post one public reply. Fake, retaliatory or fraudulent reviews are prohibited and removed.

7. Content moderation & illegal content (DSA Art. 14)

Prohibited content includes anything illegal, fraudulent, misleading, infringing, discriminatory, harassing, or that circumvents Octo's fees or PII gating (e.g. sharing contact details to avoid a lead unlock).

Octo moderates through: provider validation before activation, review moderation before publish, redaction of contact data before lead purchase, and admin arbitration of lead disputes. We may remove content, refuse a quote, or restrict a listing.

Any person may notify allegedly illegal content at {{DSA_CONTACT_EMAIL}}, describing the content, its location and why it is unlawful. When we restrict or remove content or an account, we provide the affected user a statement of reasons and information on how to contest the decision.

8. Liability

As an intermediary, Octo is not liable for the acts, omissions, quality or legality of any provider's or client's service, nor for their contract. To the extent permitted by law, Octo's liability for the platform is limited to fees the provider paid Octo in the preceding 12 months. Nothing limits liability that cannot be excluded under mandatory Spanish or EU consumer law.

9. Suspension & termination

We may suspend or terminate an account for breach of these Terms, unlawful conduct, non-payment of fees, or failed validation, with a statement of reasons where required. You may close your account at any time; retained records follow our Privacy Policy and legal retention duties.

10. Governing law & disputes

These Terms are governed by Spanish law, without prejudice to the mandatory consumer protections of the user's EU country of residence. Data protection is supervised by the AEPD. Consumers may use the EU ODR platform. Legal notices: {{LEGAL_EMAIL}}.
