1. Identification of the operator

In accordance with Article 10 of Spanish Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSI-CE), the operator of the website https://octo.services and of the Octo Services platform (the "Platform") is:

  • Legal name: {{COMPANY_LEGAL_NAME}}
  • Legal form: {{COMPANY_LEGAL_FORM}}
  • Tax ID (NIF/CIF): {{COMPANY_NIF}}
  • Registered address: {{REGISTERED_ADDRESS}}
  • Commercial Registry: {{MERCANTILE_REGISTRY}}
  • Telephone: {{LEGAL_PHONE}}
  • Email: {{LEGAL_EMAIL}}

2. Purpose and nature of the service

Octo Services operates an online marketplace that connects individuals and businesses seeking a service ("Clients") with vetted professional service providers ("Providers") across Spanish destinations, starting with Ibiza. Sectors include renovation, digital, home & maintenance, wellness, events and transportation.

Octo acts solely as an intermediary. Octo is not a party to the service contract concluded between a Client and a Provider and never processes the payment for the underlying service between them. Providers alone remunerate Octo, through: a lead-unlock fee (from €5 to reveal a Client's contact details), a service fee (2% by default, or a fixed amount, on an accepted quote), and an optional premium subscription (€59/month). Price estimates shown on the Platform are non-binding indications, not offers or quotes.

Octo provides the technical intermediation, matching and hosting services; it does not guarantee the performance, quality or outcome of any service contracted between a Client and a Provider, who remain solely responsible for their agreement.

3. Intellectual property

The Platform and all of its elements — software, source code, database structure, design, graphics, logos, trademarks, texts and other content produced by Octo — are the property of {{COMPANY_LEGAL_NAME}} or its licensors and are protected by intellectual and industrial property law. Any reproduction, distribution, public communication, transformation or extraction, in whole or in part, without prior written authorisation is prohibited. Content submitted by users (requests, quotes, reviews, documents) remains theirs; by submitting it they grant Octo the licence needed to operate the service.

4. Single point of contact (users and authorities)

Under Regulation (EU) 2022/2065 (Digital Services Act), Octo designates a single point of contact for direct communication with users and with Member State authorities, the Commission and the European Board for Digital Services:

  • Point of contact: {{DSA_CONTACT_EMAIL}}
  • User support: {{SUPPORT_EMAIL}}

Notices of allegedly illegal content may be sent to the address above and will be handled through our notice-and-action procedure. The languages of communication are English, Spanish and French.

5. Liability

Octo uses reasonable efforts to keep the Platform available and its information accurate but does not warrant uninterrupted, error-free operation. As an intermediary hosting provider, Octo is not liable for content stored at users' request of which it has no actual knowledge of illegality, in accordance with the LSSI-CE and the Digital Services Act; upon obtaining such knowledge it acts diligently to remove or disable access to it.

6. Data protection and cookies

The processing of personal data is governed by our Privacy Policy, and the use of cookies by our Cookie Policy. The supervisory authority is the Spanish Data Protection Agency (AEPD, https://www.aepd.es). Data protection queries: {{PRIVACY_EMAIL}}; Data Protection Officer {{DPO_NAME}}, {{DPO_EMAIL}}.

Any dispute shall be submitted to the courts of Spain competent under applicable law; where the user is a consumer, the mandatory jurisdiction rules protecting consumers under EU and Spanish law apply. Consumers may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
